Chapter I General Provisions

Article 3 The environmental protection work of chemical mines shall run through the whole process from resource exploration, development research, construction and production to mine closure. Article 4 In the process of resource exploration, development, research, construction and production, chemical mines shall comply with relevant environmental protection laws, regulations and standards, and shall implement the “China Science and Technology Policy Guidelines – Environmental Protection” and “Chemical Industry Environmental Protection”. "Technical Policy" and reference to the implementation of the "China Nature Protection Program lw" and other relevant provisions.

Article 5 These Provisions apply to all levels of management departments, enterprises and institutions in the chemical mining industry.

Article 6 Workers in the chemical mining industry have the right to supervise, report and sue for acts causing environmental pollution and damage to the ecological environment, and are protected by law.

Chapter II Organization and Responsibilities

Article 7 The competent departments at all levels of the chemical mining industry may set up environmental agencies or provide full-time environmental protection personnel to manage environmental protection work. Each factory mine can set up an environmental protection agency or a full-time character according to needs, and do a good job in environmental management, environmental research, environmental monitoring and other aspects of the enterprise. All institutions should have environmental management tasks, and be responsible for the environmental geological or environmental protection research, environmental assessment, environmental engineering design, environmental monitoring, environmental education, environmental protection infrastructure and other aspects of the department.

Article 8 Responsibilities of Environmental Protection Departments

1. The environmental protection work of the competent department shall be fully responsible by the person in charge of the competent department. The business units of the plan, production infrastructure, scientific research, design, and geology of the unit should do a good job in environmental protection related to their own work. On this basis, the environmental protection functional department should do the following work well.

1. Responsible for implementing national and local laws, regulations, standards, guidelines and policies related to environmental protection, and integrating, coordinating and supervising the environmental protection work of the department.

2. Formulate the environmental protection development plan and environmental protection research plan of the department, and coordinate the simultaneous development of production and environmental construction.

3. According to the "Several Provisions on Environmental Protection Management of Chemical Industry Construction Projects", manage and check the implementation of the environmental impact report (form) approval system and the environmental engineering "three simultaneous" system.

4. Carry out the inspection and supervision of the implementation of the “Several Provisions of the State Council on Combining Technological Transformation and Prevention of Industrial Pollution”.

5. Organize and coordinate the environmental monitoring work of the department according to the "Industrial Environmental Protection Monitoring Work".

6. Formulate environmental protection assessment indicators and annual environmental protection plans for this system, and organize implementation and regular inspections.

Organize the training of environmentally friendly products of this system.

2. The environmental protection work of enterprises and institutions shall be implemented by the mine manager (director, manager, president or principal). The chief administrative person in charge shall be the leader, responsible person and decision maker of the environmental protection work of the unit, and the environmental protection functional department shall do Good work below.

1. Supervise the implementation of national and local environmental laws, regulations, standards, guidelines and policies. Strengthen publicity and education on environmental protection, raise environmental awareness, and coordinate work on environmental protection. z. Organize and implement the environmental protection, environmental protection research plan and annual work plan of the unit, and incorporate it into the production development plan and annual work plan of the unit.

3. Formulate the environmental protection facilities, environmental monitoring, construction project “three simultaneous”, greening and other management rules, and organize the implementation

Participate in the technical appraisal and promotion of environmental science and technology achievements, and organize participation in environmental technology exchange meetings.

Chapter III Comprehensive prevention and control of pollution and protection of the ecological environment

Article 9 The exploration of mineral deposits must carry out comprehensive evaluation and comprehensive exploration of symbiotic and associated minerals with industrial value in the mining area, and calculate their reserves separately, and propose the conditions for comprehensive development and utilization of mines and environmental protection.

Article 10 The exploration of mineral deposits shall include the environmental geology part. Provide conditions for the accumulation of data on integrated water pollution prevention and environmental construction in mining areas.

Article 11 The beneficiation test and the development of new processes and new pharmaceuticals shall include the beneficiation and backwater test. The wastewater from the effluent plant should be tested in wastewater treatment and used as an integral part of the mineral processing test report. Otherwise, the results will not be identified and will not be promoted.

Article 12 The development and construction of a mine shall fully implement the “Regulations on Environmental Protection Design of Construction Projects” and “Several Provisions on Environmental Protection Management of Chemical Industry Construction Projects” issued by the State.

First, the construction project, the environmental impact report approval system, and the EIA work and the construction project feasibility study should be strictly implemented, and the environmental engineering “three simultaneous” system.

Second, try to use new technologies, new processes, new drugs and new equipment that do not produce pollution or produce less pollution.

3. Implementing the Interim Provisions on Several Issues Concerning the Comprehensive Utilization of Resources, which were approved by the State Council, rationally develop and comprehensively utilize resources (including three waste resources), implement the fine material policy, reduce the loss rate and depletion rate of the stope, and improve the selection. Article 13 Old enterprises shall combine technological transformation and industrial adjustment to transform the existing technological processes and comprehensively control existing pollution.

Article 14 Mining enterprises shall strengthen management, implement civilized production, and prevent the running, rushing, dripping and leaking of oil, water, gas and waste liquid to reduce pollution.

Article XV containing arsenic. More than 5% of high-arsenic pyrite ore is strictly prohibited from mining before users can solve technologies such as prevention and elimination of arsenic pollution. Mines are not allowed to be opened in scenic tourist areas, cultural relics protection areas, nature reserves. Article 16 Newly built mines shall be arranged in residential areas, hospitals, etc. on the downwind side of the mine with the lowest pollution coefficient. The main chimneys (exhaust pipes), storage facilities for toxic and hazardous materials, finished products, loading and unloading stations and main fan shafts in pits should be placed on industrial sites or on the downwind side of prevailing wind direction.

Article 17 The comprehensive prevention and control of mine dust shall be strengthened, and the prevention and control of dust with free SiO2 content greater than 10% and less than 5um shall be emphasized. In the process of mining ore, we should adopt measures such as wet rock drilling and watering to reduce dust generation and emission. Dust prevention, dust suppression, dust collection and necessary dust removal facilities shall be adopted for the production and distribution of dust spots in raw material yards, plant selection and machine repair facilities to prevent environmental pollution.

Article 18 The smoke and flue of the mining area (exhaust cylinder), the exhaust pipe of the drying facility of the plant, and the dust exhausting device temple shall pay attention to the influence of the hillside wind and the mountain airflow on the diffusion of smoke and dust, and the object shall be taken when necessary. In order to protect the health of employees and meet the quality of the atmospheric environment.

Article 19 It is forbidden to discharge tailings and waste earth stones into rivers, lakes and seas. When conditions permit, waste earth stones should consider inner rows as much as possible and restore vegetation. Tailings should consider comprehensive utilization as much as possible. Waste rock yards should take measures to prevent soil erosion. Measures to prevent mudslides and eliminate secondary pollution. The tailings pond should be cleaned and diverted to prevent dust and prevent contamination of groundwater. The slope of the tailings dam should be provided with slope protection and drainage ditch. The toxic waste residue yard should be provided with anti-seepage and interception measures.

Article 20 The mine pit and the drainage of the plant shall be reused as much as possible. The part that must be discharged shall meet the requirements of the water environment and take necessary treatment measures.

Article 21 The waste water yard drainage shall be set up according to the type of waste rock or the leaching test, and the necessary wastewater treatment facilities shall be provided.

Article 22 It is strictly forbidden to use waste mines; or contain holes, seepage, seepage pits or use purified water to dilute the standard to discharge toxic and harmful wastewater.

Article 23 The harmful sewage from the processing and plating of explosives shall be purified and can be discharged.

Article 24: The groundwater level caused by mining is declining, the ground is collapsed, and the impact on the environment shall be taken into consideration and corresponding measures shall be taken.

Article 25: Noise-mining equipment should be selected as much as possible. The general layout of the mining area should be considered to help reduce noise and shock absorption. Equipment with high noise should take measures to prevent noise.

Article 26 Chemical mines with radiation pollution shall strengthen monitoring and formulate prevention and control measures to ensure the health of employees and the environmental quality.

Article 27 The waste oil discharged from the mine shall be recovered. The outer part should be treated to the standard.

Article 28 The construction and production of mines shall occupy as little as possible of the biological resources such as farmland, cultivated land and ponds, and preserve the fertile soil layer in the occupied farmland. Strengthen greening and cultivate vegetation in the mining area. Manage forest land such as sanitary shelter belts and build a good ecological barrier. The newly-built mine greening area should be 15-20% of the industrial site area, and the old enterprises should gradually achieve more than 90% of the greenable area. Closed pits in the stope, stop waste rock yards, tailings ponds and other yards should restore the landscape. The reclamation part should be reviewed and planned in advance. Measures to prevent the formation of acid waste water should be taken for sulfide ore.

Article 29 The environmental protection funds should be disbursed in accordance with relevant state regulations. The "three wastes" comprehensive utilization products can be used to control the pollution and improve the environmental performance according to the "Detailed Implementation Rules for the Comprehensive Utilization of Chemical Industry Resources".

Chapter IV Environmental Management

Article 30 Environmental protection is an integral part of production, geological exploration, scientific research, design and teaching and life. All departments should be fully arranged and included in the planning management and production scheduling management of the system, so that they can be implemented simultaneously and simultaneously, and should be assessed once a year.

Article 31 Environmental protection facilities are an integral part of production facilities. Environmental protection equipment should be included in the management of production equipment, so that environmental protection equipment and production equipment can be maintained at the same time, and repaired and operated at the same time.

Article 32 Environmental protection indicators (such as dust qualification rate, wastewater, exhaust gas emission compliance rate, environmental protection facilities' integrity rate, operation rate, etc.) shall be included in the production and operation indicators, and shall be simultaneously issued, simultaneously implemented and evaluated at the same time as the production plan. Those who complete the environmental protection indicators shall not be rated as advanced units.

Article 33 The greening work of enterprises and institutions shall be undertaken by a special person, and the greening plan shall be included in the overall plan of the unit.

Article 34 Environmental pollution accidents shall be dealt with in a timely manner. Relevant environmental protection departments of major accidents shall submit a written report including investigation, analysis and appraisal, with attached opinions.

Article 35 The leaders of all enterprises and institutions shall regularly report to their staff or employee congresses on a regular basis the prevention and control of pollution and the protection of the ecological environment and the improvement of the living and working environment of their employees.

Chapter V Environmental Research, Environmental Monitoring and Environmental Education

Article 36 Large-scale joint enterprises, mining bureaus, design institutes, research institutes, and colleges and universities may set up environmental protection research institutions to carry out environmental protection research work of this system to provide comprehensive environmental protection work for the mining industry. Article 39 The chemical mine environmental monitoring network consists of the Chemical Mine Environmental Monitoring Station of the Ministry of Chemical Industry and each mine environmental monitoring station (group). Work shall be carried out in accordance with the relevant provisions of the “Implementation Rules for Chemical Mine Environmental Monitoring Work” to provide a basis for mine environmental management, long-term planning for environmental protection in the chemical mining industry and overall environmental planning for each mining area.

Article 40 The chemical and mining industry colleges, secondary technical schools and technical schools shall set up environmental protection issues to raise environmental awareness. Colleges and universities with qualifications shall set up environmental protection majors and train professionals in environmental protection of chemical mines.

Chapter VI Rewards and Punishments

Article 41 Units and individuals that have made the following contributions to the environmental protection work of the chemical mining industry shall be commended and rewarded.

1. Contributing to the comprehensive prevention and control of productive dust, waste gas, production wastewater, acid drainage, noise, radiation, etc., as well as greening and reclamation.

Third, in the management, geological exploration, scientific research, design, monitoring and education, publicity and other aspects of environmental protection to make significant achievements

Article 42: For those who violate the state's laws and regulations concerning environmental protection, they shall have the following warnings: they shall be warned or notified of criticism, fines, compensation for loss, deadline for treatment or ordered suspension of production, and shall be held accountable for the perpetrators and relevant leaders. . Those who do not implement the “three simultaneous” system of environmental engineering, causing serious pollution to the environment or major damage to the ecology.

Third, management confusion or illegal operation, resulting in serious pollution accidents.

4. Use mines, and contain holes, seepage or use water to dilute the discharge of toxic and hazardous waste water, causing serious environmental pollution.

Chapter VII Supplementary Provisions

Article 43 If there are provisions that contravene the national environmental protection laws and regulations, the relevant provisions of the State shall be implemented.
